Legal Considerations and Strategies for Employers Related to the COVID Vaccines

We will review the various legal and practical issues raised for employers in light of the Covid vaccine rollout in Arkansas. The presentation will cover the legal issues employers should keep in mind when developing a vaccine strategy or policy as well as ideas for how to approach the issue of the vaccine with staff. We will cover the ADA, Title VII and Arkansas Civil Rights Act questions that are raised by implementing a Covid vaccine policy and provide tips on how to navigate those compliance issues. We will discuss what employers should consider in implementing a vaccine incentive program of any kind. As these issues are evolving, we anticipate there will be new issues that come to light between the writing of this summary and the presentation itself, and we will explore those as well as hopefully have an engaging Q &A via the chat.
Wayne Young is a partner with Friday Eldredge & Clark and a member of the Labor and Employment Law Practice Group. His practice focuses on employment and labor law including discrimination matters, harassment, wage and hour compliance, family and medical leave and covenants not to compete. He advises his clients in these matters from the compliance stage, to defending government investigations and litigation if necessary. Wayne is often called upon to speak on topics such as medical marijuana in the workplace, social media, discrimination and updates to regulations and new legislation. Wayne currently serves as General Counsel to the Arkansas State Council of the Society of Human Resource Management and that organization awarded him the Russell Gunter Legislative Advocacy Award in 2017. He is a member of Central Arkansas Human Resource Association and was awarded the association’s Legislative Advocacy Award for 2018.
